30-DAY DEADLINE TO FILE PETITION FOR REVIEW (PFR) – DWI CASES

Hi, Tyson Mutrux here again with Mutrux Finney, P.C. and today we’re discussing the 30-day deadline to file in a DWI case, a Petition For Review, whenever you refuse to do the breathalyzer or give a blood sample. So as many of you probably know, you have 30 days from the date that you are given the 15-day driving permit to file a petition for review, if you refuse to blow. If you don’t do that, you will automatically lose your license for 1 entire year. Longer if you have more than one DWI, but were talking about first time DWIs. You will lose your license for one year, and what can you do about that?

Now, if there was some sort of extenuating circumstance, in very rare occurrences a judge might say, “O.K. we’re going to allow you to continue with a Petition for Review. We have to tell you, that is extremely rare and highly unlikely. So, make sure that if you do have a refusal case; if you refuse to blow and you’re arrested for a DWI, you make sure either you file a Petition for Review, or you get an attorney to file that within 30 days. Otherwise, you’re going to lose that opportunity to challenge it, or work out an agreement with the State.
