Hi, Tyson Mutrux here again with Mutrux Finney, P.C. and today we’re discussing the topic of what level of a BAC does a person have to have to get a DWI in Missouri?
Most people know the 0.08. For most people, if you are 0.08 or over, you are going to get a DWI in Missouri. But what most people don’t realize is that, if you are under 21, and you are at 0.02 you can also get a DWI.
Also, if you have a commercial driving license, a CDL, if you have a 0.04 BAC you can get a DWI for that as well, and you will lose your license for all three of those. So, just because you may be below 0.08 doesn’t mean you’re not going to get a DWI. I think that is a common misconception. Minors may think that they can take a vehicle out and be drunk, and be O.K. if they’re below 0.08. That’s not necessarily true. There are specific laws pertaining to people under the age of 21 and CDL drivers.
