Hi! Tyson Mutrux here with the Mutrux Law Firm. Today I want to answer the question of, “Can I still file a personal injury claim even though I was in an auto accident and the police report was not created?”

The answer to that question is yes. Police respond to auto accidents all the time and they do not create police reports even though I wish they did, and sometimes people just, they exchange information and leave. Sometimes they just call a tow truck and leave. That’s it.

That’s not advisable. If you do get in an auto accident, if I were you I would call the police department and I would ask them to create a police report. They won’t always listen to you, but they should. So, can you still file a claim? Absolutely. Don’t let that deter you.
