Hi! Tyson Mutrux here with the Mutrux Law Firm. Now today I want to talk about the process for filing a vaccine injury claim in the vaccine court. Once you file the claim with all the necessary records, it then gets sent to the Secretary of Health and Human Services then also to the Department of Justice. Both of those organizations prepare separate reports and they file them with the court and they’re actually put together as one report. Those are sent to the court and what happens then is a special master’s appointed to review the claim and they determine whether or not the claim is compensable and how much the person should have received. Once it is done, the petitioner which will be you if you’re the claimant would have a chance to say whether or not you’re going to accept that amount in writing. You can’t do it verbally. It has to be done in writing. And then both sides will have an opportunity, if they like, to appeal it. You appeal it to the district court and then it can be appealed up from there. So, hopefully, that gives you better understanding with the processes.
