THE PROCESS OF OBTAINING MEDICAL RECORDS AND BILLS IN A PERSONAL INJURY CASE

Hi, Tyson Mutrux here with the Mutrux Law Firm and today I’m going to go over the process of actually obtaining your medical records and bills for a personal injury case.

Now, this is a very simple process that can be overcomplicated by many people. Either they try to overcomplicate the process and overthink it, or they just don’t do it right. It’s a very very simple process. What we do is, we get you to sign what’s called a HIPAA release, a HIPAA compliant HIPAA release. All medical providers need that before they can actually release the medical records and bills to us. So, we have you sign that document and we make sure we have all of the necessary information. Your full name, if it’s changed or you have been married we need to get that information from you. Your social security number, your date of birth, and the dates of treatment that you have gone.

We will then send that to the medical provider and we’ll request your medical records and your bills. What we do in our office is, we send it. We send a reminder in 15 days, and then another reminder in 30 days. Then it’s automatically calendared for us to check every 15 days, so we can call and get those records to you.

What a lot of firms do, is they wait. Some of you have actually experienced it, where they won’t follow up and months and months go by and your case hasn’t settled because you don’t have the medical records and bills, because you cannot settle the case without them. That’s why we have the procedures in place where we continually follow-up and follow-up until we get those. Typically we’re able to get those in less than 30 days.

That is they average process. For a more complicated case it may take a lot longer just because of the volume. Sometimes we will actually get boxes and boxes of medical records. Just for copying purposes, those are going to take a lot longer to get.
