WHAT FACTORS DOES A JUDGE CONSIDER WHEN DECIDING WHETHER TO REDUCE A BOND?

Hi Tyson Mutrux here again with the Mutrux Law Firm and today we’re going to be talking a little bit about what factors a judge considers when deciding whether or not to reduce a bond and what the procedures are to actually get a bond hearing, and a bond reduction.

So, the two main factors that a judge is allowed to consider are: whether or not you’re a flight risk, or whether or not you’re a danger to the community. The more of a flight risk you are, let’s say you live out of state, the higher the bond is probably going to be. The more dangerous to society you are, the higher the bond is going to be. How that can be established is how violent the crime is that the person may have committed. Or, let’s say you committed a litany of crimes in the past, they’re going to look at your criminal history, and say, “Well, this person is probably a danger to the community. That can be even as much as just theft. It’s not necessarily a violence, but let’s say you’re a danger to the community in a way that you’re going to go out and commit a bunch of crimes that pay for an attorney, whatever it may be. That’s going to make your bond a little bit higher.

But let’s say you need to get a bond reduction. If there is a victim involved, the State must have 5 days notice. 5 business days. So if you need a bond hearing and there is a victim involved, it’s not going to be the next day. You’re looking at at least 5 business days with a victim involved.

If there’s no victim involved, most jurisdictions will wave that 5 day requirement. You can actually sometimes get one the next day. Especially in the bigger cities you can get a bond hearing the next day without a problem at all.
