WHAT TO DO IF YOU’VE BEEN INJURED AFTER GETTING THE RUBELLA VACCINE
Attorney Tyson Mutrux describes in this video what to do if you’ve been injured after getting the Rubella vaccine
Hi! Tyson Mutrux here with Mutrux Finney, P.C.. Today I’m talking about what to do if you’ve been injured by the rubella vaccine.
Now the first thing you need to look at is the Vaccine Injury Table. It’s very key to vaccine court claims because that’s where it’s going to be filed, in vaccine court. It cannot be filed in state court. In vaccine court, it’s through federal court, so make sure whenever you’re looking for an attorney, you find someone that practices in vaccine court, so you need to look at the table.
If you want a copy of that, just go to our website www.mutruxlaw.com. We talk about the Vaccine Injury Table in other videos. You just take a look at those videos. We explain what it is, but you need to look and see if the rubella, which is listed on the table, and then the time frame for when the symptoms have to show, and what the table shows is within seven (7) to forty-two (42) days, okay? So, as long as your symptoms started to show within seven (7) to forty-two (42) days, you probably have a compensable injury.
Something you need to know about attorney’s fees is that attorney’s fees are actually paid on the hourly basis through the vaccine court. They’re not paid by you. So as long as you have a viable claim, attorney’s fees are paid through the vaccine court, and that’s where you receive your compensation as well. The vaccine court actually pays you out of that claim.
There are statutes of limitations that apply to these claims, so make sure you file within the statute of limitations. You should call someone right away if you think you have a claim.
