Hi! Tyson Mutrux here with the Mutrux Law Firm. Today what I want to do is I want to talk about what you should do if you’re injured after taking the tetanus vaccine. Now there are a few different things that could have happened, some few different types of symptoms that could occur after taking the vaccine, so you’re going to look at how soon the symptoms occurred.
If you actually suffered anaphylaxis or anaphylactic shock, that had to occur within four (4) hours of the injury; otherwise, you may not be able to receive compensation. The other thing is brachial neuritis; if that occurred, that’s usually within two (2) to twenty-eight (28) days.
Remember, this is based upon the Vaccine Injury Table; this tells us those guidelines. So, things you need to know about the vaccine court is, you can’t file for vaccine injuries in state court. You have to file them through the vaccine court and federal court. It’s a separate process. You need to find someone that actually practices and does vaccine court cases because if you get someone that thinks they should file in state court, you’ve got the wrong attorney. They don’t know what they’re doing. Another thing you need to know, there are statutes of limitation that apply to your claim, so make sure you call someone right away because if you miss that, if you don’t file within the statute of limitation, you will not be able to be compensated.
