Hi! Tyson Mutrux here with the Mutrux Law Firm. Today I’m answering the question of, “Who do I file the claim against if I was in an auto accident and the at-fault party was in a company vehicle?”

The answer to that question is you go against the driver and the company. It’s based upon the theory, respondeat superior. What that says is that, if the individual driving is working for the company in the course and scope of the employment, you can also go after that employer. So, you file a claim, but if you’re not able to settle that claim, you also will file suit against both parties, so you’ll sue that individual driver and the company.
