Hi! Tyson Mutrux here with the Mutrux Law Firm. Today I’m talking about what happens if you’ve been injured at work and your employer does not have workers compensation insurance.
Although you’re in a tough situation, you have a few options. You can still file a claim with the Division Workers Compensation for the Second Injury Fund and then also against your employers, so you can still go after them. They just have to pay outside of the insurance. You have a third option and you can file in a circuit court in the state of Missouri; it depends on where you live and where your employer is located, and actually that expands the amount of liability against the employer because there are certain protections within the Division Workers Compensation when an employer does have insurance; however, if they do not, they expose themselves to more liability.
