Hi! Tyson Mutrux here with the Mutrux Law Firm. Today I’m answering the question of whether or not you should sue in small claims court for your auto accident case. The answer to that question is probably not. The reason why that is because there’s a lot of pain and suffering that’s involved in an auto accident claim, a lot of medical bills are involved in an auto accident claim. They will put you in excess of the $5,000 small claim limit. So, if it’s a very, very minor auto accident where maybe there’s an emergency room, no follow-up care, yeah it’s fine, and if the insurance company is not going to pay that amount, which they should but they don’t, yeah, feel free to file a small claims court case. However, I would not recommend it. Normally you would want to file in associate circuit court at the bare minimum if not in the circuit court.
