What is an Opening Statement?

Hi! Tyson Mutrux here with the Mutrux Law Firm. Today I’m answering the question of, “What is an opening statement?” An opening statement is simply an oration of what the evidence is going to show from your party’s perspective. The plaintiff goes first and then the defendant, and the parties are supposed to not argue the facts. However, the good attorneys are able to sneak in their facts from time to time just to kind of put their little spin on it and hopeful they’re able to get in before they get an objection. So, an opening statement is very simple. It’s not evidence. You’re talking about what the evidence is going to be at trial. You’re not putting on any evidence at all. So, that’s it. It’s just an opening statement.
