Today I’m answering the question of, “What is a cross-examination?” This is another one of those terms you’ve probably heard on all those legal shows. “Cross-examination, it’s a big part of the case.” All it is, it’s your opportunity to ask the other side’s witnesses questions. That’s it. Nothing else. On cross-examination you’re able to lead the witness; on direct examination, you’re not. Meaning, you’re able to basically lead them down the path of questions. For example, “Isn’t it true that…?” or “Didn’t you know that…?” or things like that where you can lead them. They’re loaded questions. It’s much different from direct examination where you’ve got to ask a lot of open-ended questions.

The Main Purpose of Cross-Examination

The primary goal of cross-examination is to test the truthfulness and credibility of a witness. After a witness testifies for their own side (called “direct examination”), the opposing lawyer gets a turn. This is their chance to poke holes in the story, highlight inconsistencies, and expose any bias the witness might have.

In short, it’s where your attorney gets to challenge the other side’s version of the facts and bring the truth to light for the jury.

How is Cross-Examination Different from Direct Examination?

The biggest difference is the types of questions allowed.

  • During Direct Examination, an attorney must ask open-ended questions like “What did you see next?” or “How were you feeling?” They are not allowed to “lead” their own witness.
  • During Cross-Examination, the attorney is allowed to ask “leading questions.” This is the most powerful tool. A leading question suggests the answer, such as, “Isn’t it true that you were looking at your phone at the time of the crash?” or “You were in a hurry, weren’t you?”

This allows your lawyer to control the narrative, forcing the witness to give simple “yes” or “no” answers and trapping them if they try to change their story.
