Need a Missouri Personal Injury Lawyer Near You?

If you were hurt in an accident anywhere in Missouri, Mutrux Firm Injury Lawyers can help. Whether it was a crash on I-70 or I-44, a fall at a local business, or a dog bite in your neighborhood, we handle injury claims and wrongful death cases for people in both big cities and rural counties.

Missouri’s injury laws apply the same way across the state, but every claim starts with the facts of what happened to you. Attorney Tyson Mutrux and our team will review your case for free and explain your options before you talk to an insurance company.

Where Will Your Missouri Injury Case Be Filed?

Missouri has 114 counties plus the independent City of St. Louis, grouped into 46 judicial circuits. Where your lawsuit goes is set by Missouri's venue law. In most injury cases, RSMo 508.010 says the case is filed in the county where you were first injured, not the county where you live or where the other driver lives. A crash on I-70 in Callaway County is filed in Callaway County, even if you live in Kansas City and the other driver lives in St. Louis.

That matters because each county has its own courthouse, judges, docket speed and jury pool. A lawyer who handles cases in courts across the state knows what to expect in each one and can plan for it from the start.

Rule What it means for your claim Source
Same deadlines statewide The five-year deadline for most injury lawsuits, and three years for wrongful death, apply the same in every Missouri county. RSMo 516.120, 537.100
Venue follows the injury Most injury cases are filed in the county where the crash or injury happened. RSMo 508.010
City claims can have a 90-day notice rule If a city vehicle or a dangerous city street or sidewalk caused your injury, some cities must get written notice within 90 days, well before the lawsuit deadline. RSMo 82.210
Limits on claims against public entities Claims against the state, counties and cities are allowed only in certain situations, such as crashes involving a government vehicle or a dangerous condition of public property, and damages are capped. RSMo 537.600, 537.610

Can We Handle Your Case If You Live Far From St. Louis or Columbia?

Yes. Most of the work in an injury case does not require you to come to our office. We can talk by phone or video, collect medical records and bills directly from your providers, and send documents for electronic signature. When the case needs someone at the crash scene, at a deposition or in the courtroom, our lawyers travel to the county where the case is filed.

Our two offices, at 222 S Central Ave, Suite 550, in St. Louis and 2415 Carter Ln, Suite 102, in Columbia, sit along the I-70 corridor that connects much of the state. From there we represent people hurt in the Kansas City area, in Springfield and the Ozarks, in Jefferson City and mid-Missouri, in Southeast Missouri and in small towns in between. Call (888) 550-4026 for a free case review, wherever in Missouri you were hurt.

Missouri Motor Vehicle Accident Lawyer: Navigating State-Wide Laws

While our office is deeply rooted in St. Louis, as a Missouri motor vehicle accident lawyer, Tyson Mutrux represents victims across the entire state. Missouri has specific “Pure Comparative Fault” and “Statute of Limitations” laws that differ significantly from our neighbors in Illinois or Kansas. Understanding these nuances is the difference between a denied claim and a maximum settlement.

Key Missouri Traffic Laws for Accident Victims

If you’ve been injured on Missouri roads, whether on I-70 in Columbia or a busy intersection in St. Louis, the following state laws apply to your case:

    • Pure Comparative Fault (RSMo § 537.765): Missouri is a “Pure” comparative negligence state. This means you can recover compensation even if you were 99% at fault for the crash. Your final settlement is simply reduced by your percentage of fault. Insurance companies often try to “inflate” your fault to save money; we fight to keep that percentage as low as possible.

    • The 5-Year Statute of Limitations: For most motor vehicle accidents in Missouri, you have five years from the date of the crash to file a lawsuit. While this seems like a long time, evidence like dashcam footage and witness memories can disappear in weeks.

    • “No Pay, No Play” Law: If you were driving without insurance at the time of the accident, Missouri law may bar you from recovering “non-economic” damages (pain and suffering), even if the other driver was 100% at fault.

    • Minimum Insurance Requirements: Every Missouri driver is required to carry a minimum of 25/50/25 liability coverage and Uninsured Motorist (UM) coverage. If you are hit by a driver with no insurance, your own UM policy steps in to cover your injuries.

Why Hire a Lawyer Who Handles Cases Across Missouri?

Hiring a Missouri motor vehicle accident lawyer who understands the local court systems in both St. Louis City and County ensures your case is handled with precision. From filing the correct Form 1140 (Motor Vehicle Accident Report) with the Department of Revenue to litigating in front of Missouri juries, we provide the aggressive representation needed to secure your future.

What Are the Steps to Take After an Accident in Missouri?

The first steps are much the same whether you were hit by a car, hurt on someone else's property, or injured on the job. What changes is who you report to, who ends up paying, and how long you have. Missouri answers each of those differently depending on how you were hurt, which is why the early record matters as much as the injury itself.

    First

    Right After It Happens

    • 01

Get medical help the same day. Being seen early creates the record that ties the injury to the event. Waiting a week gives the other side room to argue something else caused it.

    • 02

Report it to the right person. Police for a crash, the manager for an injury at a business, your supervisor for an injury at work. Each one creates a different record, and each has its own clock.

    • 03

Photograph it before it changes. Vehicles get towed, spills get mopped, and broken equipment gets repaired. Capture the cause and the surroundings while they still look the way they did.

    • 04

Collect names and numbers. Witnesses, the other parties, and anyone who responded. People scatter within minutes and become very difficult to find weeks later.

    Next

    In the Days After

    • 05

Follow your treatment plan. Keep every bill, record, and receipt. A gap in treatment is the first thing an adjuster points to when arguing the injury was not serious.

    • 06

Ask whether you have more than one claim. An injury at work usually means a workers' compensation claim against your employer, and sometimes a separate claim against a contractor, driver, or equipment maker who also caused it.

    • 07

Watch for liens on your recovery. Health insurers, Medicare, Medicaid, and hospitals can all claim repayment out of a settlement. Knowing what is owed is part of knowing what an offer is actually worth to you.

    • 08

Be careful with the adjuster. You are not required to give the other side's insurer a recorded statement, and anything you say in one can be used to shift fault onto you or reduce what you recover.

    • 09

Know which deadline applies. Missouri generally allows five years for a personal injury claim and three years for wrongful death, while claims against a city or public entity can require written notice within months.

    FAQ

There are a few common questions on Missouri personal injury law. Let’s review them below so you can stay informed.

How do I file a personal injury claim in Missouri?

Most claims start with the at-fault party's insurance company, not a lawsuit. Get medical care, document what happened and keep every bill. Once your treatment is complete or stable, your lawyer sends the insurer a demand for compensation. If the insurer will not pay fairly, the next step is filing a lawsuit.

Is Missouri a no-fault state for car accidents?

No. Missouri is an at-fault state, so the driver who caused the crash and their insurance company are responsible for your damages. You can file a claim with that driver's insurer or sue them directly. Missouri also follows pure comparative fault, so you can still recover if you were partly to blame, though your award is reduced by your share of fault.

What car insurance is required in Missouri?

Every Missouri driver must carry liability coverage of at least $25,000 per person and $50,000 per accident for injuries, plus $25,000 for property damage. Uninsured motorist coverage of $25,000 per person and $50,000 per accident is also required. Because these minimums are low, we also look for other coverage, such as your own underinsured motorist policy if you have one.

How long do I have to file a personal injury lawsuit in Missouri?

Most personal injury lawsuits in Missouri must be filed within five years of the injury (RSMo 516.120). Wrongful death claims generally must be filed within three years of the death (RSMo 537.100), and medical malpractice claims within two years (RSMo 516.105). Claims against government entities can have much shorter notice requirements. Missing a deadline can end your right to compensation, so speak with a lawyer early.

What compensation can I recover in a Missouri personal injury case?

Missouri law lets an injured person recover economic losses, such as medical treatment already received and care needed in the future, missed paychecks and a reduced ability to earn, and repair or replacement of damaged property. It also covers non-economic losses like physical pain, emotional suffering and lost enjoyment of life. Punitive damages are possible only when clear and convincing evidence shows the defendant intended harm or deliberately disregarded others' safety, and they are usually capped (RSMo 510.265). When an injury is fatal, close family members can pursue a wrongful death claim covering burial expenses, the income and services the person would have provided, and the loss of their love and guidance.

Who pays for medical bills after a car accident in Missouri?

At first, your own health insurance or MedPay coverage usually pays your medical bills as you get treatment. Because Missouri is an at-fault state, the at-fault driver's insurer is ultimately responsible, but it typically pays only when the claim settles. The settlement then reimburses your health insurer and covers remaining costs, and we negotiate those reimbursements to keep more money in your pocket.

How much does it cost to hire a Missouri personal injury lawyer?

Mutrux Firm Injury Lawyers works on a contingency fee basis, so there are no upfront fees. Our fee is a percentage of the money we recover for you, and if we do not recover anything, you do not pay a fee. The exact percentage and how case costs are handled are explained in writing before you sign anything.

Can I file a claim for emotional distress if I was not physically injured?

Sometimes. Missouri allows emotional distress claims without a physical injury when someone's negligence created an unreasonable risk of harm and the distress is medically diagnosable and medically significant, such as PTSD diagnosed by a doctor. Bystanders generally must have been in the zone of danger themselves. These claims depend heavily on medical evidence, so a doctor's evaluation is important.

What should I do after an accident or injury in Missouri?

Get medical care right away, even if you feel fine, so there is a record of your injuries. Report the accident to the police or the property owner, photograph the scene and your injuries, and collect witness names. Keep your bills and records, and talk to a lawyer before giving a recorded statement to any insurance company.

How do I choose the best personal injury lawyer in Missouri?

Start with facts you can confirm instead of advertising claims. Check the lawyer's license on the Missouri Bar directory, read client reviews, and ask whether the lawyer has handled cases like yours and will file suit if the insurer refuses a fair offer. Tyson Mutrux is listed with the Missouri Bar and the Illinois ARDC, has been chosen for Super Lawyers each year from 2024 through 2026, and spent part of his career evaluating claims for State Farm. Those are the kinds of credentials worth comparing between firms.
