How Long a Typical Personal Injury Case Takes

Attorney Tyson Mutrux describes in this video how long a personal injury case typically takes.

Hi, Tyson Mutrux here with the Mutrux Law Firm and right now what I want to do is discuss how long your typical auto accident or a personal injury case takes. Now, your state of, run-of-the-mill, auto accident or slip and fall, it typically takes 3 months to 6 months if we do not file a lawsuit on the case. So that’s to settle pre-suit.

The more serious the case, or the more serious the injuries, the longer the case should take because most insurance companies will not negotiate with you without all of your treatment being completed. So, if your treatment takes 9 months, a year, 2 years, typically the case is delayed that long. In all honesty you don’t want to settle the case prior to that because you want to make sure that all of your medical bills, and your long-term medical bills are taken care of  and accounted for. For example, if you need a surgery in 18 months of the auto accident, or whatever the cause of the injury was, you want to wait until that’s completed so that you can include that in your actual settlement amount, so that your medical bills and everything are taken care of. You don’t want to try and settle that prior to that because it’s only going to hurt you.

If you file a lawsuit however, your case is probably going to take 1-2.5 years to finally get from beginning to end. So keep that in mind. It’s usually 1 year-18 months from the time you file a lawsuit. Especially in St. Louis where there are so many cases in those venues.
