Out-of-Pocket Expenses in Personal Injury Cases

Hi, Tyson Mutrux here again with the Mutrux Law Firm and today we’re talking about how much you’re going to be paying out-of-pocket for a personal injury claim.

Now, some people are very hesitant to even get them an attorney because they think it’s going to cost them a lot of money. But, with a personal injury claim I’d say probably 99.9% of attorneys out there charge on a contingent-fee basis. What that means is, they don’t get paid unless you get paid. And they don’t get paid until you get paid, meaning you’re not going to have any out-of-pocket expenses. Now, that’s only about fees.

If you want to talk about real out-of-pocket expenses, you may actually be out-of-pocket other money not to the actual attorney but just in every-day occurrences. Let’s say you need to go out and buy ice packs and your insurance company doesn’t pay for it. You’re talking about ointments, creams, and whatever else you may need for any injuries, cuts bruises, scrapes and things like that. You may have to hire a cab driver occasionally to get you here to there, whenever you vehicle is being repaired.

Another expense that people don’t think about is actually deductibles if you have health insurance. So, a personal injury claim, even though in the initial onset you may think, “Oh it’s not going to cost me anything”. It is going to cost you some money so keep that in mind. That’s why we always recommend that people keep a journal of things. Not just for what’s going on with your everyday life, but actually for expenses. People forget about that stuff. They’re paying out-of-pocket for prescriptions and things like that. These are things people forget about that they can be compensated on the back end out of their injury claim. They just don’t track it so it’s harder for us to submit that as part of our claim. That’s why we have our clients actually put that journal together so that we can look at it, and actually include that in our demand letter. So dont’ forget about things like that, incidental expenses people usually forget about.
